United States v. Peebles

The Eighth Circuit affirmed defendant's conviction for two offenses related to his participation in a drug trafficking conspiracy. The court held that there was sufficient evidence to convict defendant of conspiracy to distribute more than 100 grams of heroin and possession with intent to distribute 100 grams or more of heroin. In regard to defendant's evidentiary challenges, the court held that the district court did not err by admitting statements made by a coconspirator; defendant was precluded from raising the issue of whether a prior conviction was properly admitted for impeachment purposes; the district court did not abuse its discretion by permitting testimony from a drug trafficking expert; and the district court did not err when it precluded defendant from questioning two police officers.
