United States v. Hemsher

by
The Eighth Circuit affirmed defendant's conviction and sentence for firearms-related charges. The court held that the evidence was sufficient to support defendant's conviction for possession of stolen firearms and for being a felon in possession of a firearm; there was no extraordinary circumstance in this case permitting the court to review the jury's credibility determinations; evidentiary challenges were rejected; the district court did not err by imposing a sentencing enhancement under USSG 2K2.1(b)(1)(B) based on the number of weapons involved in the offenses, USSG 2K2.1(b)(6)(B) for possessing the firearms in connection with another felony offense, and USSG 3C1.1 for obstruction of justice; and the sentence imposed did not create unwarranted sentencing disparities.
